Although legislative victories of the Civil Rights Movement fueled optimism about U.S. race relations, the fall of Jim Crow segregation was not enough to eliminate racial inequality and antiblack racism. In the 1980s and 1990s, a network of law professors, mostly scholars of color, began to document how the law continued to sustain and perpetuate unequal power relations. This body of work emerged as Critical Race Theory, a rigorous examination of how the law constructs and sustains racial power and subordination.

“Critical Race Theory,” as it is used today, is a disinformation campaign carefully orchestrated to stir white opposition to anti-racist education and racial reform in the workplace. In the aftermath of international unrest, following the murders of George Floyd and Breonna Taylor, rightwing formations launched a crusade to counteract the racial reckoning that appeared to elevate the consciousness and activism of a significant segment of the non-Black population.
