a) Can the Malaysian Courts try Alex for the murder of Brendan? 

b) Can the Singaporean Courts try Alex for the murder of Brendan? 

c) Would your answer differ if Alex tortured Brendan before killing him?

TOPIC 8: STATE RESPONSIBILITY

QUESTIONS 

1. What is State Responsibility and why is it important in International Law? 

2. What kind of acts/omissions can bring rise to an obligation to make reparation? Is there a need of mental element to accompany those acts/omissions? 

3. Discuss the situations when acts/omissions of an individual can give rise to State responsibility. 

4. What can be raised to preclude the wrongfulness in the context of State Responsibility? 

5. In the event no circumstances precluding wrongfulness can be raised, what will happen to the State guilty of the wrongdoing? 

6. The State of Ironia entered into a treaty with Thoria where Thoria will build various buildings and structures inside the territory of Ironia. Ironia brought in their own workers despite there being a high rate of unemployment in Thoria and many Thorians were hoping (in vain) to get a construction related job. 

The relationship soon grow sour between Ironia and Thoria. The people of Thoria were poor and felt that the people of Ironia despise them. 

A group of armed Thorians went one night into one of the Ironian construction site where about 150 Ironians who were working on the stadium were staying. The Thorian held the Ironians as hostages and demanded ransom.

Eventually, the hostages were released but there was great damage done to the Ironian vehicles on the construction site. 

Ironian is now alleging that the state of Thorian pays them compensation for the damage caused. Advise the state of Thorian.

• Discuss whether there is a wrongdoing or not.
• Can the acts of the armed Thorians be attributed to the State? 
• Can use the US v Iran case. Most probably the acts cannot be attributed. But subsequently, Thoria should have taken action to protect the Ironian hostages as well as the damage to the construction vehicles.
• Are there any circumstances to preclude wrongfulness? 
• The pre-conditions to bringing the claim can be raised here – are they in a position to bring a claim?
• What kind of compensation is considered to be fair in this situation?
