Hi! I like how you brought in a real-life example to explain your point; it makes the situation easier to understand. It also helps show why the bailee, In-Town Motors, could still be responsible in this case. Since the bailment was mainly for Gene’s benefit, the level of care required may have been lower, but that doesn’t mean In-Town Motors has no responsibility at all. They would still need to show they handled the Honda Fit with reasonable care under the circumstances.

Hi! I think you made a good point about counteradvertising as a tool the FTC can use when a company engages in deceptive marketing. I’d also add that the FTC isn’t limited to just correcting the messaging,mif consumers were actually harmed financially, the agency can go further and pursue remedies like refunds or restitution. This helps ensure that customers are not only informed properly but also compensated if they were misled into paying for something under false claims.

I believe that In-Town Motors would be liable for that, because it was in their possession during the time this occurred. I am assuming that you would have to read the fine print on anything that you sign when you get there for the service and when you leave. One way to prove that they did it, would be to take pictures of your vehicle before you take the car in, but I know we do not think of things like that before hand.

This would be considered false advertisement and is regulated by the FDC. They would be violating FDC regulations. Advertising candies as being big or gigantic to me means more or bigger portions than what would be in a regular bag of candy, I expect more and bigger of the product. As for the wool vs the polyester could really create an issue, some people are allergic to certain types of materials and all kinds of stuff and if you do not specify what the product is made of then you could be endangering someone's health. For example: I have allergic reaction to wool and cannot wear anything with wool in it.
