         <description><![CDATA[<div>It was developed<br>over the centuries by the decisions judges made in<br>important cases. The legal system that we know now<br>began its development during the Norman conquest<br>of 1066, but it really started to become an organised<br>system during the reign of Henry II (1154–89). When<br>Henry came to the throne, justice was usually dealt<br>with in local courts. These were:<br>• Feudal Courts – local lords dealing with issues<br>arising from the peasantry or tenants on their land.<br>• Courts of the Shires and Hundreds – county sheriffs,<br>often sitting with a bishop or earl, to hear more serious cases. <br>these early<br>courts were based on local customs that, as you would<br>expect, often differed from county to county. This lack<br>of consistency in the law at the time meant that courts<br>in different areas might settle the same dispute in<br>entirely different ways.</div>]]></description>

         <description><![CDATA[<div>the original precedent - the original precedent is referred to the initial, new precedent to be set as there is no previous decision the judge to follow until that point of time. <br><br>the binding precedent - the binding precedent refers where the present case has to follow the previous decision when there is a sufficient similarity of the facts.<br><br>persuasive precedent - persuasive precedent means precedent which a judge is not obliged to follow, but is of importance in reaching a judgement, as opposed to a binding precedent. persuasive precedents assist the decision maker in determining a case. decisions of power courts and foreign courts can be persuasive precedents. </div>]]></description>

         <description><![CDATA[<div>the decisions made by create new laws for future judges to follow for instance decisions made by a judge in a certain case are "binding" on the decisions of future judges when the facts of the cases are the same. this procedure is known as judicial precedent. <br>judicial precedent is an important part of common law. it is based on the latin saying : Stare decisis et non quieta movere which interprets as "stand by what has been decided and do not change the established". <br><br>the english legal system follows the rules of judicial precedent. meaning that courts in england and wales are required to follow decisions made in higher or superior court, and appeal courts are bound by their own decisions.</div>]]></description>

         <description><![CDATA[<div>stare decisis et non quieta movere - stand by what has been decided and do not unsettle the established. <br>where the point of law in the previous and present case is the same, the court hearing the present case should follow the decision in the previous case. <br><br>ratio decidendi - the latin term "ratio decidendi" means the "rationale or reason for a decision" and refers to that the part of the judgement which is delivered at the end of a case. usually the ratio decidendi is binding on the lower courts.</div>]]></description>
