When the results came back it ruled Brewer as a possible perpetrator and revealed an unknown male profile. It took five years, in 2007 for a new trial and found that the correct suspect was  Justin Albert Johnson. During the trial, Steven Hayne, the medical examiner who conducted the autopsy, came to the conclusion that he found several marks that resembled bite marks. They later came to the conclusion that it was "indeed and without a doubt" done by Brewer. Defense then brought in Dr. Richard Souviron, a licensed dentist who confirmed that they were indeed not bite marks but instead insect bites from being left out in the river for multiple days. Brewer later was convicted of capital murder and sexual battery on March 24, 1995, and sentenced to death. His conviction was practically entirely based on questionable marks on the body.

This witness was a foresnic psychologist who testified that Atkins was mildly mentally disabled, making him not a candidate for the death penalty. The jury sentenced Atkins to death but the Virgina Supreme Court ordered a second sentence hearing due to the trial court had used a misleading verdict form. The same forensic psychologist testified again but this time the state rebutted Atkins’ intelligence. The Commonwealth of DNA evidence had found related blood samples in Nesbitt's truck which indicated that Atkins and Nesbitt were the sources of that blood in the victims car. Atkins and Jones were drinking and smoking weed at home before the crime took place, which showed a huge increase in probability it was them. Towards the end, both Atkins and Jones both admitted to taking part in the crime, but both said it was the other who shot the gun.
