         <description><![CDATA[<div><em><sup>Published by Brittney Mayes 3/24/19</sup></em></div><div>The ASCA website includes a plethora of resources useful to School Counselors and stakeholders of counseling services in public schools. The site addresses ethical standards and professional expectations that school counselors are responsible for upholding as professional student support.<br><br>One of the ethical expectations addressed as a responsibility of the counselor to the student is bullying, sexual harassment, and child abuse reporting. Counselors have a legal and ethical responsibility to report child abuse suspicions or concerns. This responsibility is not only that of the school counselor, but also the responsibility of teachers and administrators.<br><br>Another topic discussed as a legal and ethical issue is reporting and acting on student cases of a foreseeable harm. In such cases, whether the student is a threat to themselves or others, the counselors must inform the parents or guardian, they must report it to the appropriate authorities, and must assess the risk of harm of the student and share this information with the parents and authorities.</div>]]></description>

         <description><![CDATA[<div><em><sup>Published by Brittney Mayes 2/24/19</sup></em></div><div>The NSBA website includes information regarding Student Rights and Discipline. Bullying is one of the common issues addressed under this topic. There is common knowledge that bullying can affect a student's performance at school and also their emotional health.Children cannot be expected to learn in a hostile environment. Students who live in fear of other kids or dread coming to school each day are not able to perform to their potential (NSBA, 2019).<br><br>The site explains how bullying is a serious issue that is met legal action and consequences of those who partake in such activities. The NSBA provides resources and practical tips for addressing these issues. They include details on Bullying Prevention Month, bullying and harassment laws, and lastly, bullying data by each state. </div>]]></description>

         <title>Step 2: Ex. Op. 3- Education Dive- School Liability</title>

         <description><![CDATA[<div>There has been controversy surrounding the extent to which schools and districts are accountable in regard to student safety. In an article written by Jessica Campisi and published by Education Dive,  Campisi  highlights a particular case where the courts found the school and district liable for student safety. In </div><div>M.S.D. of Martinsville v. Rebecca Jackson, a student was injured by two gunshot wounds from a school shooter, who had revealed intent to hurt the student before the act took place. The shooter threatened the student several times before the shooting, and the victim reported these threats. The teachers failed to take action, resulting in the misfortune events. The courts found the school  responsible and Jackson was compensated. This ruling shows schools or districts can be found liable if evidence proves the event could have reasonably been prevented, either because officials had reason to believe it would take place or if their response protocol wasn’t sufficiently implemented (Campisi, 2019).          <description><![CDATA[<div><em><sup>Published by Brittney Mayes 2/24/19</sup></em>In an article titled, "This Road Just Got a Lot Harder: Teachers' Union Hit with New Round of Lawsuits" the author discusses end of public sector unions' ability to collect fees.<br><br>According to the author, this lawsuit addresses two challenges in regard to limitations to when teachers can opt out of membership payroll deductions and a push for teacher fee reimbursements.<br><br>This discussion was expected to lower the number of union members and fees collected (Will, 2018).<br><br><a href="https://www.edweek.org/ew/articles/2018/10/15/this-road-just-got-a-lot-harder.html">https://www.edweek.org/ew/articles/2018/10/15/this-road-just-got-a-lot-harder.html</a></div>]]></description>

         <description><![CDATA[<div><em><sup>Published by Brittney Mayes 2/24/19<br></sup></em>School bullying is an issue that school counselors continue to address. Whether it be from in-school bullying, out-of-school, or cyber-bullying, counselors must be prepared to act. The law requires that schools create bullying-prevention plans and train their educators on how to address bullying. According to Catherine Bradshaw, author of the article titled "Translating research to practice in bullying prevention", there are tale-tale signs of an effective bullying prevention program. <br><br>The signs of an effective program include programs with effective management approaches. These approaches may include tightened supervision, consistent disciplinary methods, and classroom management strategies. Another sign of effective bullying-prevention programs are classroom and school wide rules related to bullying and training of teachers were also identified as common elements of effective programs (Bradshaw, 2015). <br><br>Additional efforts such as parent training activities and meetings, as well as, training students for bystander responses can make a major difference in the outcomes of student bullying cases, especially those which end with legal consequences.</div>]]></description>
