My interest isn't overriding as I haven't been in actual occupation, yet my interest cannot be overreaching as there is only one single trustee...<br><br>Sale only requires signature of trustee and then apply s29 LRA 2002 purchaser only bound by  interests on register and overrriding interests. </div>]]></description>

What is undue fragmentation?&nbsp;<br>6. In relation to land law, is equity the study of 'third-party interests'?&nbsp;<br>7. what is the relationship between equity and overriding interests?<br>8. To what degree are we to employ referencing and a bibliography? for both answers, or just the 1000 word answer to Q2?<br><br>1)Yes<br>2) They are different things<br>3)Not relevant to assignmnet please do not concern yourself with this at this time<br>4)I'm not sure about exatly what you mean here. Registerable dispositions are sales and transfers.Express Trusts- yes if the property has been sold or transferred inter vivos. This could enable more than one legal owner and thus more than one registered proprietor. Implied trusts- No&nbsp;<br>5)Undue fragmentation is the worry that too many people will legally own land and that requiring them all to consent will make land difficult and time consuming to sell. It is because of this worry that the law limits trustees(legal owners) to 4.&nbsp;<br>6) Again, not sure quite what you mean.&nbsp;<br>7) As above, though a very simplistic response would be to say that certain equitable interests e.g. beneficiary under trusts, equitable leasee might bind sucessors in title as overriding interests.&nbsp;<br>8)Please use refrencing and bibliography for both answers, including the problem, though the type of your references will probably differ.  &nbsp;</div>]]></description>

Yes, throughout your answer you would be expected to use technical terminology and case law. As to point 2) you need to be aware of which legal lease will overide and how a legal lease of different durations is created. For example three years or less, no formalities required due to the operation of s54(2)LPA, whereas over three years requires a deed. You do NOT need to discuss Street v Mountford which we will learn about in the second semester. Finally, onto your first point you do not contest the time, but explain the relevance of the twenty years period.&nbsp;<br><br></div>]]></description>

I presume you are most interested from the overriding interests perspective. &nbsp;Equitable easements cannot override under Sch 3 para 3. It is likely they cannot override at all, Law Commision were critical of there being able to. The only way certain equitable easments might override is under Sch 3 para 2-  actual occupation would be required.   </div>]]></description>

As for proportion it would be based on the sale price.</title>

Having said that there could be an instance where it meant the interest did not override; for example, if under scheule 3 para 3 the  implied legal easement was not obvious on inspection and had not used within the last 12 months. Abbey National v Cann might help to illustrate this. <br>A post acquisition mortgage will probably bind the lender like in Boland, as there the proprietary interest (often obtained by implied trust) does exist prior to the mortgage meaning it can override and bind under Sch 3 para 2. Post acquisition mortgages are taken out after the property is owned often to raise money for extensions or holidays etc. The important thing is that post acquisition are not used to fund the purchase   </div>]]></description>

The important knowledge to be able to demonstrate is that&nbsp; if one severs they would take a sixth. In the way that you have worded this your answer to the second question is no- joint tenants are group owners they own the whole so if one dies they all own the entirety or 5/5.<br>The other thing to note is that the automatic right of survivorship only applies to joint tenants, so to modify for example slightly, if 1 out of 6 joint tenants sever they hold a sixth which will not increase if one of the joint tenants dies - their death will only benefit the remaining joint tenants who will own the rest 5/6 between them.&nbsp;<br>NBthe understanding of the principles is what is most important rather than the mathematics&nbsp;</div>]]></description>

         <description><![CDATA[<div>give us one similar example question to one of the actual exam , please?<br>1- critically analyse 2- discus? 3- explain a quote?<br>Please which type of questions would you ask? how many words do you expect under exam conditions? help I need guidance and encouragement   <br><br>I have already said that this is an unseen exam and this means it is marked more sympathetically.<br>Equally, I have confirmed that question one will be focussed on overriding interests and suggested that students look at past papers as in essence there are looking at similar issues. Of course, there are two other essay questions licences and restrictive covenants. My advice there is to know you subject thoroughly as your essay question will be examining material we have covered   <br>I cannot give a guide on the number of words. As I have said it is quality rather than quantity which gains credit. As you have already been assessed on this topic I would refer you to the feedback for your assignment.<br>I can certainly give encouragement and reassurance, nerves are often not a bad thing from a performance perspective as they show an individual cares and are a normal response to an exam situation. Keep revising and do your best, use the teaching materials you have.        <br><br><br></div>]]></description>

Basic rules of priority will also need to be known e.g s28 and 29 LRA 2002 and any relevant overriding interest.&nbsp;<br>With regard to easements, yes, characteristics first and then formalities which will of course impact on whether legal or equitable.  <br><br></div>]]></description>

But for implied legal easments, the easement will depend on it the correct formalities were followed meaning a deed and registration. But how can it be created by deed if its an implied legal easement? Doesn't it then become an express grant?&nbsp;<br><br>You need to be very clear that both express and implied easements can be legal. Deed and registration are only formality requirements for express. Implied methods are by very nature without those sort of formalities.<br>The methods of implied creation covered in the lecture with Rob were s62, Wheeldon v Burrows and &nbsp;Prescription. There isn't must explanatory information on either though so I'm confused <br><br><br>Care needs to be taken with terminology - I think you are referring to the third category of overriding interest which is found in para 3. This is different from a third requirement for an interest to override. <br>Re your second point- these are just the sort of easements which can override under para 3 - they need to be legal and created other than by express grant that is informally. For the question one essay masses of detail on such easements is not required, just an understanding of how such easements arise informally. You might want to refer to your lecture notes also.    </div>]]></description>
