         <description><![CDATA[<div>I talked to M.K. Davis (personal interview, March 23, 2019), an elementary school counselor for more than 25 years. She shared some legal and ethical issues she has to deal with on a regular basis. She also informed me that she carries liability insurance, attends a legal and ethical session each year at a counseling conference,  keeps her ASCA ethical guidelines on her desk at all times, and consults with other counselors or an attorney when necessary.<br><br>#1- Child abuse reporting <br>Often times, teachers are reluctant to report because of fear of retaliation, so the counselor must sit with them while they make the report.<br><br>#2 Maintaining confidentiality<br>When parents or teachers refer a child, they naturally want to know what is going on or what they can do to help. The counselor can only say, "It's confidential".<br><br>#3 Documentation<br>Everything must be documented, but anything documented belongs to the school and the parent has a right to them. So documentation must be done very carefully.<br><br>#4 504 Coordinator<br>Even though this is not a role for counselors, many schools require their counselors to be the 504 coordinator. 504 is full of  legal landmines and documentation is critical.<br><br>#5 Long-term therapy<br>Many parents do not realize that the counselor can only provide short-term counseling. Anything more than about six weeks must be referred to an outside counselor.</div>]]></description>

         <description><![CDATA[<div>Texas has been denying special education students services even though they qualify for them. According to American School &amp; University (2018), "Texas has violated federal law by failing to ensure students with disabilities were properly evaluated and provided with an adequate public education". This failure to follow federal law has created some legal and ethical issues for Texas that could potentially cost schools financial problems in the future. As the state gets punished, it will invariably reduce funding to schools. <br><br>Texas, or the Texas Education Agency (TEA) encouraged schools to  cap its special education population to no more than 8.5 percent in order to avoid TEA visits (DeMatthews &amp; Knight, 2019). In the future, Texas will be watched closely by the Department of Education. It is the hope of educators that this watchful eye will help more students qualify for the special education services they need. Ethically speaking, it is wrong to deny students services based on percentages. Legally it is against federal law to deny students services they are qualified to receive. <br><br><br><br><br><br><br><br></div>]]></description>
