Article 5 of the ECHR governs the right to liberty and security, for example it includes the rights of a detainee and when a person can be lawfully detained and restrictions on this. These rights derive from the Magna Carta (1215) which originally intended to prevent the King from abusing his powers. Elements from this have been brought into modern human rights, for example PACE 1984 restricts the powers of the police and sets out what lawful detention is, furthermore habeas corpus (developed by the magna carta) is upheld through the requirement for detainees to be brought before a judge and offer bail. Article 6 of the ECHR governs the right to a fair trial. Some of the key elements for the articles are derived from historical documents such as the Magna Carta which established the need for ‘lawful judgement of peers’ which can be seen now in the use of a jury in court.
