Is NYSED considering exempting the latter students from taking the NYSESLAT, as over time they become English dominant, yet they are not meeting assessment criteria to "test out" of ENL services?

Based on the recent message, Special Ed is using ELLs/ENL as the exclusionary criteria an being over-cautious with all ELLs.  What can be done until all districts have been trained/will offer Dynamic Assessments?
