Currently there are less than a dozen countries that allow voluntary euthanasia. Putting personal feelings aside and taking an impartial look at the issue one starts to see many social issues. If you believe in basic human rights and freedoms, the ability for individuals to make decisions on how they will live out the rest of their lives is crucial. Until someone is directly impacted by an unjust law its very doubtful, they would ever put much thought on the subject. It’s unfortunate in this case that by the time they are affected it would be too late and the burden of suffering would continue.

As of June 2016, Canada passed legislation allowing eligible Canadians to request medical assistance in dying. This was in thanks to the supreme court of Canada’s ruling that in the case of “Carter v. Canada”, in order satisfy the Canadian charter of rights and freedoms that individual autonomy over one’s body would have to be upheld. In doing this Canada joined less than a dozen nations to allow such assistance to terminally ill patients.

Under the new Law a person requesting assistance must meet the following criteria:

(a) they are eligible — or, but for any applicable minimum period of residence or waiting period, would be eligible — for health services funded by a government in Canada;

(b) they are at least 18 years of age and capable of making decisions with respect to their health;

(c) they have a grievous and irremediable medical condition;

(d) they have made a voluntary request for medical assistance in dying that, in particular, was not made as a result of external pressure; and

(e) they give informed consent to receive medical assistance in dying after having been informed of the means that are available to relieve their suffering, including palliative care.

Local Application

         As this is an issue with a wide reach, it will no doubt be administered by local physicians. With Hamilton’s population size of around half a million, the need for citizens to make end of life decisions is greater than most other Canadian municipalities. Without this new law, patients only have one option and that would be to enter a palliative care center and wait till they succumb to their illness. Under current laws the federal government does not force health care providers have to assist patients if it goes against their own values and beliefs, in this case patients choosing this route for themselves are able to access a care coordination system to help assist with the right information.

With the Canadian version of medically assisted dying law only being two years old. The Legislators turned to other countries that already have their own laws in place to observe possible consequences to this provision. This is just one example of how people making strong arguments to the courts can over turn unjust laws.
