Case Study: Clifford Lambert (Background information)

Clifford Lambert was a 74 year old art dealer. He was mainly located in the Florida, Miami area, but owned homes in California too.At the time of his disappearance he was single and looking for a male companion. On Dec 4, 2008 a friend of Mr. Lambert's had received a voice mail from Clifford. The voicemail ended with Clifford asking for a call back. He called Lambert back but to his surprise, never got a reply. He waited three days, and on December 7th, 2008 he reported Lambert's vanishing. Prosecutors learned of a meeting between Daniel Garcia and Lambert from earlier in April of that year. They had met through an online dating website and Garcia had flown to California to see Lambert. Garcia sent Niroula Lambert's number and Niroula called Lambert posing as an attorney telling Lambert he ahd inherited valuable art work. The two took money from Lambert's account and flew back to where they were staying in Burbank. One year later police caught Bustamante at Lambert's house taking a truck load of art work. While in his holding cell he tells his cellmate of how he planned to kill Lambert, and his cell mate told the authorities. Police learn of another suspect, Russell Manning, an art dealer who helped the men steal Lambert's work. It was not until 2009 when Kashual Niroula, David Repogle, Russel Manning and Daniel Garcia were arrested. A year later in 2010, police decided to interview Craig McCarthy. McCarthy agrees to work with them and admits he played the part as the hit man and stabbed Mr. Lambert. He described how he stabbed Mr. Lambert in his kitchen and was able to lead investigators to the body. He takes his plea deal and was sentenced to 25 years in prison for voluntary manslaughter. Later that year Manning was charged with fraud and was sentenced to 5 years in prison. In 2011, Bustamante, and Repogle went to trial and were convicted of second-degree murder and given a life sentence with no chance of gaining parole.

In 2012, Niroula and Garcia are ready to stand trial. Garcia chooses to represent himself in court. The prosecution team hired a digital forensics researcher named Jonathan Zdiarski. The prosceution had evidence from Garcia's phone which included text messages to Niroula and Lambert. Garcia claimed that these messages were not real and not substantial enough to convict him. He also claimed the phone was mishandled by police. Garcia was caught recording his trial on his laptop in court. The recordings were taken and packaged away for more evidence. Forensic researcher Zrdriarski was able to not only prove Garcia's claim was false, he recovered even more undiscovered text messages between Garcia and Niroula that detailed the murder of Lambert. Both Niroula and Garcia were charged with second-degree murder and sentenced to life in prison. In 2016, the court of appeals sided with the two. As of 2020 the two are waiting for a retrial.

The evolution of digital forensics

Digital forensics has evolved hand-in-hand with technology. The more technology the world has gained the more types of digital evidence forensics has gained. I think that in 2020 digital forensics is a valuable resource to use because of how advanced technology actually is. It is valuable because it can provide more evidence that people would not be able to uncover without technology. Of course there are obstacles such as forgery when dealing with it. But it is a more efficient way of finding, collecting, and presenting evidence in forensics.
