Trial courts are typically were the case will begin, when there is an appellate court, there are no witnesses or evidence shown. In most states appellate courts have more than one judge where as trials most bleakly will have one judge. The last major difference between the two courts is the attendance of a jury. A jury is a group of citizens that will attend the court and put in their opinion. In a traditional trial court there will be a jury involved as well as in a criminal case however, there will never be a jury present in an appellate court.

Depending on the severity of the case, it will be decided which level of court the case will be sent to. The federal judiciary is based on a three teared hierarchy of courts. The federal courts deal with only one percent of the national judicial business. Local courts handle a lot of the small cases such as a simple ticket.
