<title>In 2016, the Supreme Court, the United States Circuit Courts of Appeals, and the Board of Immigration Appeals continued to refine the interpretation of the categorical and modified categorical approaches. These approaches, which were developed in the criminalcontext, are applied to determine whether a conviction under a criminalstatute falls within an enumerated category of crime for immigrationpurposes, e.g., an aggravated felony or a crime involving moral turpitude. They involve examination of the elements of the criminal statute ofconviction without regard to the underlying facts.</title>
