         <description><![CDATA[<div>I discussed with Beth Mcada, whom is the Guidance Counselor at Lincoln Middle School issues concerning current legal and ethical issues impacting and influencing her role as a counselor.&nbsp; The top five things listed below are her thoughts and views in regard to current legal and ethical issues.<br>#1: Maintaining and fully developing each student's academic, personal, and social skills, because of&nbsp; high demands to assist with administration, testing, and being able to actually counsel students at the socio-emotional level among the previous things mentioned is challenging.<br><br>#2: Maintaining and Protecting the rights of students under the Family Education Rights and Privacy Act (FERPA).&nbsp; FERPA is a federal law which protects the rights of students privacy. The FERPA Act is protected under the Fourteenth Amendment.<br><br>#3: Understanding responsibilities of a school district in regards to parental consent is important due to the fact that parents and legal guardians must be made aware of any activities that their child participates in.<br><br>#4: Abiding by the American School Counselor Association Code of Ethics is very important.&nbsp; By law, in regards to student records; school counselors must maintain and secure student records.&nbsp; The counselor must inform parents of any counseling services provided. &nbsp; The counselor must abide within the FERPA guidelines in reference&nbsp; to disclosing any students information. &nbsp;<br><br>#5: Employee of San Angelo I.S.D:&nbsp; The employee handbook has policies and guidelines that counselors and all other employees must abide and adhere to in relation to student's records and confidentiality and how to communicate with parents of students within the San Angelo (SAISD) School System.<br><br>(B.          <description><![CDATA[<div>The Educator's Guide to Texas School Law (Walsh, Kemerer, &amp; Maniotis, 2014)<br><br><strong>Meadows v. Lake Travis I.S.D.</strong>&nbsp; School officials have the right to request identification of any person intending to come on school property. A person who trespasses on school property commits a Class C Misdemeanor. In the case of Meadows. V. Lake Travis I.S.D. the commissioner stops a districts policy of scanning driver's licenses and other important documents upon arrival on a school campus, and used a private company to investigate criminal background checks.&nbsp; The company was trying to prevent dangerous criminals to having access to any students on campus.<br><br><strong>Mitchell v. Beaumont I.S.D.</strong><br><br>Student Kierra Mitchell was a senior who was part of the Co-operative Student Employment Program. Students were allowed to attend school for half a day and work at the job for the remaining half of the day. The student was told that they must turn in an employer evaluation form by the person who was supervising them. Kierra was also told that being supervised by a family member which was her father was verboten.<br>Kierra ignored the teacher's directives and had her father sign the evaluation form and turned the form in to her teacher. The teacher address the issue with Kierra and said that she had violated co-op policy and would likely jeopardize part of her grade and that she had to change her employment or else she would risk termination from the program. She then have Kierra to speak to the Vocational Career Counselor at West Brook. The meeting&nbsp;<br>with Kierra and the Counselor occurred during the time she was to be in the co-op class. Kierra also had an examination for this class the day that she met with the Vocational Counselor.&nbsp; Kierra had ten minutes after her meeting to complete her examination and she made a 70.&nbsp; Kierra notifies her parents of the sitaution that has taken place and her parents contact the counselor at the school.&nbsp; Kierra's mother goes to the school and goes directly to the teacher's room before speaking to the counselor.&nbsp; The teacher contact the proper authorities in the office and notify them that her class had been interrupted by an upset parent.&nbsp; Mrs. Brook meets with the counselor and afterwards she was advised by security officer appointed at West Brook, that she violated school policy by coming on to school property without a pass and disrupting a teacher's classroom could incorporate Class C misdemeanors.</div>]]></description>

I was interested in learning more about student safety issues because it is a common problem we see in the schools across the United States.  Each year we have many incidences of school safety issues in our schools systems that must be prevented in order to maintain safety of all students.</title>

         <title>Crime, violence,  discipline and safety are a few of the issues that counselors have to tackle throughout the school year.  Principals, counselors and educators and everyone involved has a stake in trying to educate and protect students who exhibits these dangerous characteristics as well as those students who are subject to these behaviors.  Every faculty member must work as a strong team in trying to prevent and minimize theses dangerous behaviors that are occurring in their schools.  Most of the time these students have learned these behaviors from home or the streets and they are evident in the schools where students are trying to receive a education.  The schools had to implement different safety plans in order to protect the students and those who teach them.  </title>

         <description><![CDATA[<div>            A survey was administered about ten years ago to principals in regards to crime, violence, discipline, and safety in their schools.  All principals willing shared their perspective on the issues that were very evident in their schools.  The survey shows that there were more incidents happening at the middle school than at the primary and high school level.  One of the factors taken into account was the student's home life.  Different safety plan  procedures  had to be placed in the schools  to protect the lives of students.</div>]]></description>
