         <title>Eighth Amendment: Bail and Punishment</title>

         <description><![CDATA[<div>T<strong>he Eighth Amendment protects an accused person before trial and after trial. Before a trial it forbids a judge from "demanding" bail. Bail is money or property given to the court to hold until a accused [person shows up for trial. After trial if the person is found guilty , the Eighth Amendment forbids " excessive fines" and "cruel and unusual punishments" it doesn't that say what punishments they are. In 1791 the most common thing was whipping.<br><br>-Why Do We Need This right?<br>We need this right because if a person is found innocent or guilty we cant just have them do nothing and let them be free, thy have to have a consequence like life sentenced in prison or something similar to that. If it is really bad they could sentence you to death.</strong></div>]]></description>
