What is Fair Use? Definition from Text Book: “the fair use of a copyrighted work, including such use by reproduction in copies … for purposes such as … teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright" (U.S. Copyright Office, 2020).

The Twist and Conditions for Fair Use is listed below.

"Purpose and Character of Use:

It This factor examines why you are copying the work and what you are intending to do with it. If used for education, scholarship, research or commentary, fair use is more likely. Whereas commercial or for-profit use would most likely weigh against fair use.

The Nature of the Copyrighted:
This factor takes into consideration of the type of work that you are copying. This includes whether the work is published or unpublished as well as if it is fiction or non-fiction. Uses of published and non-fiction works are more likely to be fair use than of unpublished and fiction works.

The Amount and Substantiality of Portion Used:
This factor considers the percentage you are copying and the importance of that in relation to the entirety of the work. Using a small portion or a piece that is not relevant to the work as a whole would favor fair use. However, using a large amount or an important part of the work would not.

Effect of Use on Potential Market:
This factor looks at how your use affects the market of the work in relation to the copyright owner. If your use takes profit away from the copyright owner or hurts the market value of the copyrighted work then, this would weigh against fair use."

Understanding the rules behind using pictures, videos and other creative work is so important. I found this very important for me becuase I have been putting together PowerPoint Presentations and using other people's pictures. Understanding how to cite work, and the rules behind copywriting is so important. If I didn't know about this, I could get myself into hot water especially as a teacher. Teachers have to be creative and sometimes unintendedly use others work. This could be so easy to do. So knowing my rights but also what I can not do really is important so I do not commit a crime, and respect others hard work and appreciate them.

I will use this information by citing my work, and making sure I am careful on what I use online. Making sure that I ask permission to use online sources, or at a school talking with my boss and figuring out a website like Creative Commons for sharing important information for class. I will be so much more aware of the expectations in the world around me, and be mindful of what I use, where I use it and how I use it. Thank you for having this as part of the class! This really helped me!
