This means that if a learner posses a dangerous weapon, the learner may face suspension, the teacher can report the learner to the principal and the principal can report the issue to the governing body. This means that when the employee is found guilty of the misconduct, the educator may be discharged by the SGB and principal of the school.</p><p><br/></p><p>QUESTION 2:</p><p>No, In terms of Section 4(4)(d) of <strong>The South African Schools Act 84 of 1996</strong>, no learner may possess or use dangerious objects, within the school premises. This means that if a learner is found in possession of a firearm or weapon that may cause harm to other individuals and damage to the property an expulsion may occur. No learner is to carry any dangerous weapon or firearm at school.</p><p><br/></p><p>Question 3:</p><p>According to Section 11(b) of <strong>The South African Schools Act 84 of 1996</strong>, provincial regulations must be consulted in the compilation of a list of offences that may lead to the suspension of a learner. Offences that may lead to such suspension include, but are not limited to, the following: possession, threat, or use of a dangerous weapon. If a teacher finds a learner with a firearm at school, the teacher must report the matter to the principal's office for a learner suspension. No learner is allowed to bring a firearm to school.</p><p>According to Section 11(b) of <strong>THE GUIDELINES FOR A CODE OF CONDUCT FOR LEARNERS OF 1998, </strong>If a learner is found in possession of a dangerous weapon, the learner may be suspended. The teacher may suspend the learner from the class and the school as the weapon can cause harm to other individuals. </p><p><br/></p><p>Question 4: </p><p>Everyone at school is responsible for preventing and ensuring that bullying doesn't take place in a safe and secure learning environment. According to <strong>Section 10(10.1) (a) of THE SOUTH AFRICAN SCHOOL ACT 84 OF 1996</strong>, in case of minor offenses, corrective measures may be applied. These measures could include one of the following: a verbal warning or written reprimand by an educator or a principal. No learner is to treat or mistreat others in an unhuman manner.</p>]]></description>

         <description><![CDATA[<p>QUESTION 1 </p><p>According to the Employment of Educators Act chapter 5, incapacity and misconduct, section 16 states that  'if alleged that an educator is unfit for the duties attached to the educators post/incapable of carrying out those duties efficiently, the employer must assess the capacity of the educator and may take action against the educator in accordance with the incapacity code and procedures for poor work performance as provided in Schedule 1". (2) if it is alleged that an educator committed misconduct as contemplated in subsection (1), the employer must institute disciplinary proceedings in accordance with the disciplinary code and procedures contained in schedule 2. (3) if after having followed the procedures contemplated in subsection (2) a finding is made that the educator committed misconduct as contemplated in subsection (1)  the employer may, in accordance with the disciplinary code and procedures contain in schedule 2 impose a sanction of counselling, a verbal warning, a fine not exceeding one months salary,  suspension without pay for a period of not exceeding 3 months, demotion, a combination of the sanctions refferes to in paragraphs (a) - (f) / dismissal if the nature extent of the misconduct warrants dismissal. The SGB may take action when educator is found guilty of misconduct. </p><p><br/></p><p>QUESTION 2</p><p>No, according to the Regulations for Safety Measures at Public Schools, South African schools act 84 of 1996 section 4 (4) (b) states that no educator, parent/ learner, and no other person, may posses/ use dangerous objects during any school activity. It means that no one is allowed to be in possession of a firearm on school grounds as it may harm others. The school can notify the police about the incident so that legal action may proceed. </p><p><br/></p><p>QUESTION 3</p><p>According to the Guidelines for a code of conduct for learners section 11 (b) offences that may lead to such suspension include, but are not limited to the following possession threat/use of a dangerous weapon under subsection (13.2) it states that any learnwe alleged to have violated any rule that may require suspension or explusion, must be brought to the principal. The teacher must stake the learner to the principal. </p><p><br/></p><p>QUESTION 4</p><p>According to the guidelines for a code of conduct for learners section 5 (5.1) (b) learners must be involved in the formulation of school and classroom rules and must conform to such rules. This means the educator and learners works together to make the class rules and the learners follow the rules. Failure to adhere to the rules will result to some sort of punishment. </p>]]></description>

Dit beteken nadat die prosedures in subartikel (2) beoog, gevolg is, ‘n bevinding gemaak word dat die opvoeder wangedrag, soos beoog in subartikel (1) gepleeg het, kan die werkgewer, in ooreenstemming met die tugkode -en prosedures in Bylae 2 vervat, ‘n sanksie oplê van – berading, ‘n modelinge waarskuwing, ‘n finale skriftelike waarskuwing, ‘n boete nie een maand se salaris te bowe gaan nie, skorsing sonder salaris vir ‘n tydperk hoogstens 3 maande verlaging in rang, ‘n kombinasie van die sanksies in paragrawe (a) tot (f) bedoel, of afdanking, as die aard en omvang van die wangedrag afdanking regverdig. Dus sal die beheerliggaam stappe teen daardie persoon neem indien hul skuldig bevind is aan wangedrag.</p><p><br/></p><p>2. Nee, ingevolge artikel 1(b) en Artikel 4(2) (a) –(c), SA Skolewet, Wet 84 van 1996, Regulasies vir Veiligheidsmaatreëls by Openbare Skole, “Gevaarlike voorwerp beteken enige vuur -of gaswapen, geen prsoon mag enige gevaarlike voorwerp op die openbare-skoolperseel toelaat, bring/hê, berg nie, buiten op amptelike aangewese plekke wat die skoolhoof bepaal”. Dit beteken dat indien ‘n leerder ‘n vuurwapen skool toe of ‘n skoolaktiwiteit bring, sal dit so gou as moontlik by die departementele owerhede of polisie aangemeld word. Dus is dit onwettig om enige gevaarlike voorwerp na die skoolterrein te bring en sal regstappe geneem word indien ‘n leerder gevang word met ‘n gevaarlike wapen om beide die leerder en ander leerders se veiligheid te bewaar.</p><p><br/></p><p><strong>3.&nbsp;</strong>Ingevolge artikel 4(1) (g), Regulasies vir Veiligheidsmaatreëls by Openbare Skole, 84 van 1996. “Willens en wetens die besit van gevaarlike voorwerpe, goedgekeur, toelaat, wegsteek, steun of aanmoedig, of nalaat, versuim of weier om die waarneming of teenwoordigheid van enige gevaarlike voorwerp so gou as moontlik by die departementele owerhede of die polisie aan te meld. Artikel 8 A (6) (a) &amp; (b), ), Regulasies vir Veiligheidsmaatreëls by Openbare Skole, 84 van 1996, “ As die polisie die gevaarlike voorwerp nie dadelik by die skool kan afhaal nie, moet die prinsipaal of sy of haar gedelegeerde gevaarlike voorwerp naaste polisie stasie neem of aan die naaste polisie oorhandig om daaroor te beskik ingevolge artikel 31 van die Strafproseswet, 1977( Wet 51 van 1977). Dit beteken dat indien die onderwyser ‘n leerder met ‘n vuurwapen kry, moet hulle dit aanmeld, en mag direkte en indirekte skade veroorsaak vir enigeen wat ‘n persoon aan die kaak stel wat die voorkoming van gevaarlike voorwerpe en aktiwiteite probeer fnuik nie. Dus is dit belangrik dat die onderwyser belangrike regstappe moet neem indien ‘n leerder ‘n vuurwapen na die skool bring.</p><p><br/></p><p>4. Ingevolge artikel 28(1)(f)(ii) in die Grondwet van Suid-Afrika, wet 108 van 1996, " Elke kind het die reg om nie verplig of toegelaat te word om werk te verrig of dienste te lewer nie wat 'n risiko vir die kind se welsyn, opvoeding, liggaamlike of geestelike gesondheid of geestelike, morele of sosiale ontwikkeling inhou. Dit beteken dat die "Wet op Skoleveiligheid", 84 van 1996, vereistes vir skole moet stel met betrekking tot die voorkoming en hanteering van afknouery, wat vereis dat skole 'n beleid teen afknouery en geweld moet hê. Dus is dit die skool en almal wat verantwoordelikheid het teenoor die kinders by die skool, se verantwoordelikheid om te verseker dat afknouery by die skool voorkom word.</p>]]></description>

Section 4 (4) (d). “No educator, parent or learner, and other person, may possess or use - dangerous objects, during any school activity.” This means that no one especially the learner is allowed to have a dangerous object/weapon at school. The implication to this Act is that is when a learner is found with a weapon on the school premises he/she may face disciplinary actions.</p><p><br/></p><p><br/></p><p>Question 3</p><p>According to the South African Schools Act 84 of 1996, Guidelines For A Code of Conduct For Learners. Section 11 (b). “Provincial regulations must be consulted in the compilation of a list of offenses which may lead to suspension of a learner.          <description><![CDATA[<p><strong>Student number – 33791228</strong></p><p><br/></p><p><strong>Question 1- </strong>According to section 11(1)(e) of the Employment of Educators Act, 76 of 1998, educators may be discharged on account of misconduct. In terms of section 18(2) of the Employment of Educators Act, 76 of 1998, if it is alleged that an educator committed misconduct as contemplated in subsection (1), the employer must institute disciplinary proceedings in accordance with the disciplinary code and procedures contained in Schedule 2.</p><p><br/></p><p><strong>Question 2-</strong> No. According to the GUIDELINES FOR A CODE OF CONDUCT FOR LEARNERS, it states in section 1.4 that The Code of Conduct must inform learners of the way in which they should conduct themselves at school in preparation for their conduct and safety in civil society. Section 3.5 also mentions that learners must understand that action may be taken against them if they contravene the Code of Conduct. In terms of section 4(2)(b) of The South African Schools Act, 84 of 1996, no person may carry any dangerous object in the public-school premises. In terms of section 4(4)(d), no learner may possess or use dangerous objects during any school activity.</p><p><br/></p><p><strong>Question 3- </strong> In terms of section 8A(12)(a) of The South African Schools Act, 84 of 1996, a learner may be subjected to disciplinary proceedings if a dangerous object is found in his or her possession. According to section 11(b) of the GUIDELINES FOR A CODE OF CONDUCT FOR LEARNERS, 1998, offences that may lead to such suspension include possession, threat, or use of a dangerous weapon.</p><p><br/></p><p><strong>Question 4-</strong> SGB, principal, educators, parents/caregivers, community, and external organizations are all responsible for preventing bullying from schools and to work together to create a safe environment for learners.</p><p>&nbsp;</p>]]></description>
